Summary

In the case at issue an application was filed for the In Rem restitution of substantial material movables for Jewish community organisations. The claim was not made by a Jewish community organisation or its legal successor and as a result was rejected as it was out of the jurisdiction of the Arbitration Panel for In Rem restitution.

Furthermore, a claim was also made for the In Rem restitution of properties without the submission of a specific address. The Arbitration Panel was able to identify one or more properties that could be related to the claim. However, on the cut-off date, the 17th January 2001, these properties were not publicly owned according to the General Settlement Fund Law. As there was no specific property to restitute, the claim was rejected.
